Terms of Service

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and ReleaseFly. If you do not agree to these Terms, you may not access or use the Service. We may update these Terms at any time; continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

ReleaseFly is a SaaS platform that lets you create and publish product changelogs, collect email subscribers, and send update notifications. The Service is provided on a subscription basis with both free and paid tiers.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to:

• Publish spam, misleading content, or illegal material
• Harvest or collect email addresses without consent
• Send unsolicited commercial email (spam)
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with the Service's infrastructure or other users

We reserve the right to suspend or terminate accounts that violate these rules without notice.

5. Subscription and Payments

Paid plans are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions auto-renew unless canceled before the renewal date. No refunds are issued for partial billing periods. Prices may change with 30 days' notice.

6. Free Plan Limits

The free plan includes 1 project, 30 changelog entries, and 100 email subscribers. We reserve the right to modify these limits at any time with reasonable notice.

7. Your Content

You retain ownership of all content you publish through the Service. By using the Service, you grant ReleaseFly a limited license to store, display, and transmit your content as necessary to operate the Service. You are solely responsible for the accuracy and legality of your content.

8. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

The Service, including its software, design, and branding, is owned by ReleaseFly and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the fullest extent permitted by law, ReleaseFly's total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages of any kind.

12. Termination

You may cancel your account at any time from your billing settings. We may suspend or terminate your account for violation of these Terms. Upon termination, your data may be deleted after a 30-day grace period.

13. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law.
